NFP Plus -Grant Writing and Consultancy Services - Terms and Conditions
1. Services
The Consultant will provide grant research, grant writing, application preparation, review, submission support and related consulting services as agreed with the Client.
2. No Guarantee of Funding
The Client acknowledges that all funding decisions are made solely by the funding body. The Consultant does not guarantee funding success or the award of any grant.
3. Client Information
The Client warrants that all information, budgets, financial information, project details, quotes and supporting documentation supplied to the Consultant are accurate, complete and current.
4. Client Responsibilities
The Client is responsible for providing information requested by the Consultant in a timely manner and for responding to requests for clarification or additional information.
5. Draft Reviews and Approvals
The Consultant may provide draft applications, budgets and supporting documents for review. The Client is encouraged to review all materials prior to submission and notify the Consultant of any concerns or inaccuracies.
6. Submission Authority
Where authorised by the Client, the Consultant may submit applications on the Client's behalf.
7. Reasonable Care and Skill
The Consultant will exercise reasonable care and skill in the preparation of grant applications and related services.
8. Limitation of Liability
To the maximum extent permitted by law, the Consultant's total liability arising from the provision of services is limited to the total fees paid by the Client for those services.
9. Exclusion of Consequential Loss
The Consultant shall not be liable for loss of grant funding, loss of opportunity, loss of profits, indirect loss, consequential loss or any funding decision made by a funding body.
10. Funding Body Decisions
The Consultant has no control over grant assessment processes, funding allocations, assessment outcomes or decisions made by funding bodies.
11. Intellectual Property
All templates, methodologies, systems and proprietary materials remain the property of the Consultant unless otherwise agreed in writing.
12. Confidentiality
The Consultant will maintain the confidentiality of information supplied by the Client except where disclosure is required by law.
13. Fees and Payment
Fees are payable in accordance with the agreed proposal, quote or invoice. Fees are payable regardless of the outcome of any grant application.
14. Refunds
Any refund or goodwill remedy offered by the Consultant shall be at the Consultant's discretion and shall not constitute an admission of liability.
15. Professional Indemnity
The Consultant may maintain Professional Indemnity Insurance at a level considered appropriate for the services provided.
16. Governing Law
These Terms and Conditions are governed by the laws of New South Wales, Australia.
17. Acceptance
Instruction to commence work, payment of an invoice, acceptance of a quote, or continued engagement of services constitutes acceptance of these Terms and Conditions.
